life1 Collaborative Family LawA team is stronger than an individual.  The same is true with divorce.  You need to think about a team that can work together to help you through one of the most difficult times in live.  Who are the players?  Well, it depends on you and the complexity of the process.

Let’s begin with the mediator.  A mediator will facilitate and lead the team with you.  He or she will begin with an initial consultation to understand your needs, desires and complexity of the case.  Every now and then, cases are so simple and straight forward, you may only need a mediator.  Most people will need other team members.

A very important member of your team is an attorney.  Genesis Mediation can work with any attorney.  However, our experience demonstrates those attorneys with actual training in Collaborative Family Law work best within the mediated process.  You will find a number of collaborative attorneys listed on the Resource tab of the website.  Some will retain these attorneys, others will want to consult them as needed.  In a collaborative system, the attorneys can be present for mediation, or help you come to sessions prepared for negotiations.  WARNING: if you select an aggressive litigating attorney, the mediation process will be difficult.

Other important members include a Certified Divorce Financial Analyst or a Financial Planner.  These people have a rich background and education in finances to help sort through the money maze.  They can assist in asset settlements, project financial impact based on current decisions in the divorce process, and give you assistance in creating and maintaining cash flow.  A CPA or a tax consultant is often needed to figure tax implications of decisions made in settlements.

Mental health in a vital area of concern through divorce.  Most people ride the roller coaster of anger, depression, entitlement, and fear to mention just a few emotions.  A competent Divorce Coach will help you navigate the troubled waters of divorce.  A counselor acting as a Divorce Coach is different than regular therapy.  They come along side to resource and support you during the process of the actual divorce.  If you have children, a session with a child therapist may prove very helpful.  You may select to continue therapy post divorce to address other issues. If you are currently in therapy, Genesis Mediation requests a confidentiality release in order to speak with your therapist.  This helps the therapist become part of your greater team.

Mortgage brokers and realtors are usual team members in dealing with the primary residence.  Many couples struggle with decisions around the house and feel limited by the current economy.  There are many creative alternatives surrounding the house in mediation.  Your team can help you come up with one that creates a win/win for both parties.
